1. Acceptance of Terms

By accessing and using QurioLens ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and QurioLens.

2. Service Description

QurioLens is a Software-as-a-Service (SaaS) platform that provides AI-powered digitization and metadata extraction services for postcard images. Our Service allows users to:

• Upload images of postcards (front and back)
• Utilize artificial intelligence to extract text, metadata, and other information from uploaded images
• Export processed data to CSV format for use in external platforms such as eBay
• Access processed data through a web-based dashboard

3. AI Disclaimer and Accuracy

CRITICAL: The AI-powered analysis provided by QurioLens is probabilistic in nature and may contain errors. Our Service uses machine learning models to analyze images and extract information, including but not limited to:

• Optical Character Recognition (OCR) for text extraction
• Metadata extraction (dates, locations, subjects, etc.)
• Image classification and categorization

We do not guarantee 100% accuracy of any OCR results, metadata extraction, or other AI-generated content. The accuracy of results may vary based on image quality, clarity, language, handwriting, and other factors beyond our control.

You are solely responsible for verifying all output before using it for any commercial purpose, including but not limited to creating eBay listings, sales descriptions, or any other business use. You acknowledge that you will review, validate, and correct any errors in the processed data before relying on it.

4. User Content and Intellectual Property

4.1 Ownership

You retain all ownership rights to the images and content you upload to the Service ("User Content"). By uploading User Content, you represent and warrant that:

• You own the User Content or have obtained all necessary rights, licenses, and permissions to upload and process it
• You have the right to grant the licenses described in these Terms
• The User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party
• The User Content complies with all applicable laws and regulations

4.2 License to QurioLens

By uploading User Content, you grant QurioLens a worldwide, non-exclusive, royalty-free license to:

• Store, process, and analyze your User Content to provide the Service
• Use your User Content to improve our AI models and Service quality (subject to our Privacy Policy)
• Display your User Content within your account dashboard

This license terminates when you delete your User Content from the Service, except that QurioLens may retain copies as necessary to comply with legal obligations or for backup and recovery purposes.

4.3 Copyright and DMCA

QurioLens respects intellectual property rights. If you believe that any User Content infringes your copyright, please contact us at support@quriolens.com with a DMCA takedown notice that complies with the Digital Millennium Copyright Act.

5. Prohibited Uses

You agree not to use the Service to:

• Upload, transmit, or process any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Upload content that contains viruses, malware, or any other malicious code
• Violate any applicable local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated systems (bots, scrapers, etc.) to access the Service in a manner that exceeds reasonable use
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, sublicense, or otherwise commercialize the Service without our express written permission
• Interfere with or disrupt the Service or servers connected to the Service

Violation of these prohibitions may result in immediate termination of your account and access to the Service, and may subject you to legal liability.

6. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate, current, and complete
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. QurioLens is not liable for any loss or damage arising from your failure to protect your account credentials.

7. Subscription Tiers and Payments

7.1 Subscription Plans

QurioLens offers both free and paid subscription tiers. Features, usage limits, and pricing are subject to change at any time. Current subscription details are available on our website.

7.2 Payment Processing

Payments for paid subscriptions are processed through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's terms and conditions. QurioLens does not store your full payment card information.

7.3 Billing and Renewal

Paid subscriptions automatically renew at the end of each billing period unless you cancel your subscription. You authorize us to charge your payment method for the renewal period.

7.4 Refund Policy

All payments are non-refundable, except as required by applicable law. Subscription fees are charged in advance for the billing period. If you cancel your subscription, you will continue to have access to paid features until the end of your current billing period.

8. Service Availability and Modifications

The Service is provided on an "As Is" and "As Available" basis. We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time with or without notice
• Perform scheduled or unscheduled maintenance that may temporarily interrupt Service availability
• Update, change, or remove features or functionality of the Service

We will make reasonable efforts to notify you of significant changes to the Service, but we are not obligated to provide advance notice for all modifications.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting us at support@quriolens.com or through your account settings. Upon termination, your right to use the Service will cease immediately.

9.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms of Service
• Violation of any applicable law or regulation
• Engagement in fraudulent, abusive, or illegal activity
• Extended period of account inactivity

9.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account, User Content, and processed data, subject to our data retention policies and legal obligations. We are not liable for any loss of data resulting from termination.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, in no event shall QurioLens, its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Business interruption or loss of goodwill
• Costs of substitute services
• Damages resulting from errors, inaccuracies, or omissions in AI-generated content
• Damages resulting from data loss, corruption, or unauthorized access
• Any other damages arising out of or in connection with your use of the Service

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding the accuracy, reliability, or completeness of AI-generated content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties that defects will be corrected

We do not warrant that the Service will meet your requirements or that the results obtained from the Service will be accurate, reliable, or suitable for your intended use.

12. Indemnification

You agree to indemnify, defend, and hold harmless QurioLens, its directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your User Content.

13. Governing Law and Dispute Resolution
